Alabama Sentencing Worksheet
Alabama Sentencing Worksheets in Alabama were updated as of October 1, 2016. One of the most frequently asked questions we get when a new client contacts The Nelson Law Firm, especially after the client has done their own preliminary research, is “what is the Alabama Sentencing Worksheet?” and “does it apply to me?”. The answer is usually “maybe”.
The first thing to know is that the Alabama Sentencing Worksheet is a threefold worksheet. One applies to “Property Crimes”, another applies to “Drug Crimes” and another applies to “Personal Crimes”. The first thing to know is that ,typically, Class A Felonies are NOT covered by the Alabama Sentencing Worksheet. These include Rape 1st, Robbery 1st, Drug Trafficking & Criminal Mischief 1st. This list in not exhaustive but it is reasonable to say that Class A Felonies are not covered by the Alabama Sentencing Worksheet.
Having said that, if you are charged for a crime that is covered by the Alabama Sentencing Worksheet, it is easiest to think of it as a similar point system to a driver’s license. If you exceed the allowed points you will receive a “jail recommendation”, if you score less than the allowed points you can have various other potential outcomes. In calculation your “number” on the worksheet, various factors are considered such as criminal background and the severity of the offense.
